The High Court of the Federal Capital Territory in Abuja has granted interim bail to former Attorney-General of the Federation, Abubakar Malami, SAN. The decision comes amidst an ongoing case involving the Economic and Financial Crimes Commission (EFCC) and was delivered on December 23, 2025, by Justice Bello Kawu.

Justice Kawu’s ruling stipulated that Malami’s bail terms mirror those previously set by the EFCC. This includes the crucial requirement of surrendering his international passport to the court. Furthermore, the bail is contingent upon Malami providing two sureties who will execute the necessary bail bonds.

The two sureties identified to fulfill this obligation are the Director-General of the Nigerian Legal Aid Council and a sitting member of the House of Representatives. This representative is specifically from the Augie/Argungu Federal Constituency, ensuring a degree of accountability and standing.

In his order, Justice Kawu also reviewed and effectively reactivated the bail conditions that Malami had already met on November 28, 2025. These previously fulfilled conditions included the provision of the aforementioned two sureties and the surrender of his international passport.

The court’s decision to grant interim bail was based on grounds of exceptional hardship faced by the former Attorney-General. This provisional release is intended to remain in effect pending the full hearing and final determination of the substantive motion on notice.

The legal proceedings have been adjourned to January 5, 2026. On this date, the court is scheduled to hear the substantive motion on notice, which will further address the details of Malami’s case and the bail conditions.
